DONAHUE, Justice. The plaintiffs declaration alleges that while he was crossing Hampshire Street in the city of Lawrence he was struck by an automobile operated by the defendant. The case was tried before a jury in the Superior Court on the report of an auditor and on the testimony of the parties and other witnesses. There was a verdict for the plaintiff. Various exceptions taken by the defendant have here been argued.
